Structuring a Personal Injury Settlement When a Child Is Injured
Our law firm is experienced in the various ways a lawsuit settlement agreement can be structured to provide for a child’s future needs. Some of the tools we use include special needs trusts to maximize the value of the settlement, guardianships for an injured child, and settlements that include annuities to increase the total dollar value of the settlement and its total worth to the child and the family.
An example: Three children were injured and a fourth child was killed in a house fire caused by the children’s father. We obtained a settlement on behalf of the surviving children with a cash value of $157,000. However, because of how we structured the settlement, the total value of the settlement is at least $800,000. With advice from professional annuitants, the children purchased $157,000 worth of annuities: each child will receive significant payouts for four years starting at age 18, to pay for a college education. Each child will also receive a significant payout at age 28 to provide a down payment for a home. With careful financial planning, our clients were able to more than triple the value of the settlement.
